A ‘Dazed And Confused’ Lawsuit

An American singer/songwriter is suing Led Zeppelin guitarist Jimmy Page for alleged copyright infringement, claiming to have written and recorded “Dazed And Confused” two years before it appeared on Zep’s debut album.
In court documents filed on Monday, Jake Holmes cited a 1967 copyright registration for his own “Dazed And Confused,” according to London’s Guardian newspaper which says Holmes renewed the copyright in 1995.
How close does the Zeppelin classic resemble Holmes’ tune? Although it sounds somewhat different and the lyrics are not the same, there seem to be enough similarities between the two works to make even the casual listener wonder if Jimmy Page might have heard Holmes’ song at one time.
Plus, there are plenty of indications that Page might have been familiar with Holmes work. In a 2001 interview posted by online magazine Perfect Sound Forever, Holmes talked about opening for The Yardbirds in 1967 when Page was a member of the famed British band, referring to the gig as “the infamous moment of my life when ‘Dazed And Confused’ fell into the loving arms and hands of Jimmy Page.”
Apparently The Yardbirds heard Holmes’ song and decided to cover it. However, The Yardbirds broke up one year later, which resulted in Page forming a new band that would eventually be called Led Zeppelin. As every Zep fan knows, “Dazed And Confused” appeared on the band’s first album.
But, aside from the title, is Holmes’ “Dazed” the same as Zep’s? You be the judge.

Now Holmes is suing Page, along with Super Hype Publishing, Atlantic Recording Corporation and Rhino Entertainment Company for copyright infringement. However, due to the statute of limitations, he can only sue for monies made on the song during the past three years. Otherwise, he’d probably sue for an amount that would definitely leave more than a few people dazed.

I laughed reading some of the comments on youtube... seems some folks have no clue what songwritting is... I knew Page stole stuff, but this is insane... what was he thinking... I'm glad the guy is suing, only wondering why he waited over 40 years? I'm sure it's a bundle of money...

Wow. Amazingly blatant. Pretty much the same song---Jake's is almost like the demo, and Zep's the recorded version. Yes, why indeed did he wait 40 years to sue????

Of course they ripped off Jake Holmes. They should've at least given him a writing credit! He tored the States with the Yardbirds in '67, I think.

I may be wrong, but doesn't the Yardbirds recordings of the track feature the same lyrics as the Holmes' version?

I do not see the reason why....

Any jury with a set of ears would find substantial similarity in those songs.
Page will cut him a big fat check to go away.
Unless this guy has some bitterness that he wants to make a statement.

The 40 year wait is odd.
Page could have an argument there that the guy essentially sat on his hands.
Wasn't as if the Zep song was buried.

Led Zep has a history of stealing songs that ain't theirs, & they credit themselves as the songwriters, Like The Lemon Song which is Killing Floor which never has been credited to Willie Dixon or is it Chester Burnett (Howling Wolf)
I hope the guy wins his case & gets money for it.

Ok.just listened to the original for the first time. Yeah Page took the basic concept of the song. But I don't think it's that blatant of a ripoff. I'd say the Zep version is pretty different.

you can't write your own version of a song... that's the point of writing and copyrighting a song, otherwise it would be total chaos... the laws regarding writing, are about the basic part of a song... there's ways to steal songs and ideas that aren't illegal, and make them your own... and then sometmies, a song is a song, and you either write it or you play someone else song... in this case, Page played a guys song and tried telling and selling at his own... lame and illegal. and I beleive the law regarding this, is that any use of it in the past 3 years to make money and sell it, is why the limitations aren't up... and it will allow for the suit to go back past 3 years, since it will considered and ongoing crime.
Remember when The Stones changed writing credits ASAP, with Anybody Seen My Baby... they were smart, any artist that even remotely thinks they may have used anothers song or writing puts themselves on dangerous legal ground. With Zeps already known history of stealing songs, they are fucked, unless a legal loophole saves thems... they are guilty from my POV, without a doubt, the only real question is where does the real songwriter stand and will he get justice. I hope he does.
I'm glad he came forward and I really hope all legal decisions go in his favor. I'd love to know why he waited, but legally, he doesn't have to have a reason, since... it isn't legally relevanyt as far as the case is concerned!!!
