Father arrested for growing marijuana after neighbor posts signs advertising drug house
By Katie Wedell | Wednesday, May 18, 2011, 11:00 PM

A female known for calling police on her neighbors about everything from parking to drugs and alleged threats, apparently decided to take matters into her own hands when she suspected a male on her street was selling drugs.

The 50-year-old female, who calls police multiple times a day with false or unsubstantiated claims, was seen putting up signs across the city with this message:

“Tim’s Illegal Drug and Trade. Celebrating over three years of the best illegal drugs and goods. Everything under one roof: Crack, meth, pills, ice, plus more. Curbside service… just honk for prices. My wife or daughter will get you what you need. Don’t have money??? We take food stamps, stolen goods and trade. Just off Wayne Ave and Watervliet at 1813 Brookline Ave - upstairs.”

This image from a WHIO-TV video shows part of one of the signs placed around Dayton by a neighbor supposedly advertising an illegal drug business at the Brookline address. The family that lives at that address contacted police to complain that the male, whose first name is indeed Tim, had lost his job after his boss saw the sign.

Police agreed to summon the female who posted the signs on possible charges of making false alarms and went to the family’s home to talk with them about additional charges for causing them hardship.

While at the house, an officer asked to take a look around to prove that there were indeed no drugs in the house. The female resident gave her permission.

In addition to a generally cluttered house with at least 10 cats occupying one bedroom and causing the house to smell like cat urine, the officer discovered a 3-foot tall marijuana plant growing in another bedroom. The plant weighed more than 100 grams.

When asked about the plant, the male resident said it was for personal use and that he found it in a trashcan. He said he doesn’t sell any drugs because if he did he’d, “live better”, according to a police report.

He was transported to the Montgomery County Jail and faces possible charges for the illegal cultivation of drugs and also for child endangering.

His 6-year-old daughter lived at the house and did not have a bedroom to sleep in, one bedroom being dedicated to the cats and another to the pot plant

Yeah, I remember this in the news when I visited last September.

I don't know about other countries, but I heard it is illegal for Americans to break American laws abroad, even if an activity is legal in that country.
Never heard of an American being prosecuted for that, though.

Yeah, I think someone failed a drug test and argued they were in Amsterdam smoking and not in America. I think I remember reading that a few years back....or maybe I was plotting my defense strategy? lol

The federal government ruled on Friday that marijuana has no accepted medical use and should remain in the same class of drugs as heroin.

The decision comes nearly nine years after marijuana supporters asked the government to reclassify the drug to take into account the growing body of research conducted across the globe that proves it's effective in treating certain diseases, reports The Los Angeles Times.

The paper spoke to advocates who criticized the ruling but are pleased that the government has finally responded, which allows them to appeal to the federal courts.

Calif. pot dispensaries told by feds to shut down

U.S. prosecutors send letters even though state law allows

By LISA LEFF

SAN FRANCISCO — Federal prosecutors are cracking down on some pot dispensaries in California, warning the stores that they must shut down in 45 days or face criminal charges and confiscation of their property even if they are operating legally under the state's 15-year-old medical marijuana law.

In an escalation of the ongoing conflict between the U.S. government and the nation's burgeoning medical marijuana industry, at least 16 pot shops or their landlords received letters this week stating they are violating federal drug laws, even though medical marijuana is legal in California. The state's four U.S. attorneys were scheduled Friday to announce a broader coordinated crackdown.

Their offices refused Thursday to confirm the closure orders. The Associated Press obtained copies of the letters that a prosecutor sent to at least 12 San Diego dispensaries. They state that federal law "takes precedence over state law and applies regardless of the particular uses for which a dispensary is selling and distributing marijuana."

"Under United States law, a dispensary's operations involving sales and distribution of marijuana are illegal and subject to criminal prosecution and civil enforcement actions," according to the letters signed by U.S. Attorney Laura Duffy in San Diego. "Real and personal property involved in such operations are subject to seizure by and forfeiture to the United States ... regardless of the purported purpose of the dispensary."

The move comes a little more than two months after the Obama administration toughened its stand on medical marijuana. For two years before that, federal officials had indicated they would not move aggressively against dispensaries in compliance with laws in the 16 states where pot is legal for people with doctors' recommendations.

The Department of Justice issued a policy memo to federal prosecutors in late June stating that marijuana dispensaries and licensed growers in states with medical marijuana laws could face prosecution for violating federal drug and money-laundering laws. The effort to shutter California dispensaries appeared to be the most far-reaching effort so far to put that guidance into action.

"This really shouldn't come as a surprise to anyone. The administration is simply making good on multiple threats issued since President Obama took office," said Kevin Sabet, a former adviser to the president's drug czar and a fellow at the University of Pennsylvania's Center for Substance Abuse Solutions. "The challenge is to balance the scarcity of law enforcement resources and the sanctity of this country's medication approval process. It seems like the administration is simply making good on multiple statements made previously to appropriately strike that balance."

Mojo I just happened to hear the biggest of all dickheads in the world on the radio on the way home tonight. Joe Russinello, former US Prosecutor for San Francisco many moons ago. He still thinks marijuana is a drug in the same class as heroin. I know Barry O has a lot of shit to deal with. But somebody at some point has to look at legalizing marijuana as a legitimate source of revenue.

By The Associated Press

BEAVER, Pa. -- A defense attorney's argument that a bag of marijuana uncovered during a Pennsylvania traffic stop could have belonged to a man other than his client unraveled after an arresting officer recalled the suspect asking him: "Can I have my weed back?"

Nineteen-year-old Devonte Davon Jeter was one of four men in a car stopped by Midland police on May 13.

Jeter's attorney said Monday that the marijuana could have belonged to any one of the men in the car.

But the prosecutor told the judge: "I don't know what else 'Can I have my weed back?' can mean, other than it's his."

The Beaver County Times reports that a district judge agreed with the prosecutor and ordered Jeter to stand trial on marijuana possession charges.
