None of this is pretty. In fact it's repugnant. But this is WAR. We are hated by Islamic Fundamentalists BECAUSE WE EXIST. Back to this awesome and very unoriginal
scenario (have you ever seen that show "24"?
That happens in every episode), let's suppose
the Bad Guy still won't spill the beans, even
after 189 waterboardings. BUT we have HIS
son in custody too. His son looks like this:

Should we torture HIM to try to get the information
out of his dad?
Because the question is not this hackneyed old "ticking time bomb"
scenario that Lady Jane and Keifer Sutherland posit. It's whether
we're on the same level with the terrorists, and whether anyone is
above the law. Who made the decision that waterboarding ISN'T torture,
after hundreds of years of it being considered exactly that. Was it "the
guys in the field"?
Whoever it is should stand trial. And a court of law should decide.

That's here on earth. I can assure you that no one who has ever
tortured anyone is getting into heaven.
