WASHINGTON - Live Nation Entertainment Inc.'s Ticketmaster unit has reached a settlement with federal regulators to refund money to people who bought marked-up tickets to 14 Bruce Springsteen concerts last year.

The settlement, announced Thursday by the Federal Trade Commission, will give customers the difference between the marked-up price and the face value of their tickets. FTC Chairman Jon Leibowitz said the refunds could go to thousands of people and ultimately total more than $1 million.

The FTC launched an investigation into Ticketmaster's practices last year after Springsteen fans who tried to buy tickets for concerts in May and June encountered a "no tickets found" message on Ticketmaster's Web site. The investigation found that even though face-value tickets were still available in many cases, customers were redirected to Ticketmaster's TicketsNow.com resale site to buy tickets that were in some cases two, three or even four times face value.

According to the FTC complaint, which was filed in U.S. District court in Illinois, TicketsNow charged a markup of 2 per cent to 8 per cent, as well as a 15 per cent fee, on the Springsteen tickets.

The FTC said the company used "deceptive bait-and-switch tactics." It also said the company displayed the same misleading Web page to consumers trying to buy tickets to other events between October 2008 and February 2009.

In addition, the agency said that Ticketmaster failed to tell buyers that many of the resale Springsteen tickets advertised on the TicketsNow.com site were not actually "in hand," but rather were simply offers to try to find tickets. As a result, the FTC said, many of those "phantom tickets" never materialized even though Ticketmaster kept the sales proceeds for several months before notifying customers that the tickets did not exist.

The settlement with the FTC will require TicketsNow.com to clearly disclose whether tickets advertised on the site are in hand or merely speculative and to clearly indicate that it is a resale site that offers tickets at resale prices.

The agency is also sending warning letters to other ticket resale companies urging them to review their own Web sites to ensure that they do not make any misleading statements about the status of tickets.

Live Nation Entertainment denies that there were any face-value Springsteen tickets available when customers were redirected to the TicketsNow.com site - even though it said at the time that its systems had a "glitch." The company stressed in a statement that the FTC did not find "any inappropriate transfer or diversion of tickets to TicketsNow or any other resale entity."

The company said it is pleased with the terms of the FTC settlement and looks forward to building a "great company that serves consumers and artists with easy and transparent ticketing solutions." Ticketmaster, the nation's largest ticket-seller, and Live Nation, the world's largest concert promoter, merged last month after a yearlong antitrust review by the Justice Department.

Fans have been crying, waiting, and hoping since then... but the wait is almost over. In early June, the 32nd anniversary of the release of the original album, we'll see the release of Darkness on the Edge of Town: Special Anniversary Edition.

Or should we say Editions? Following the lead of Radiohead, Nine Inch Nails, and Barry Manilow, Springsteen and Sony are releasing the Darkness box in several configurations. The basic set echoes the format of the 6x12 Born to Run box:

Disc 1: remastered Darkness on the Edge of Town CD
Disc 2: DVD documentary, Straight Into Darkness, on the making of the album, including interviews with band members, staff of the Record Plant, and cover photographer Frank Stefanko
Discs 3-4: DVD of the August 15, 1978 show at Largo, Maryland (22
songs, starting with "Summertime Blues")
Not enough for you? You might want the Expanded Anniversary Edition, which also includes:

Disc 5: CD of 13 outtakes from the Darkness sessions, none of which have been previously released, including "Preacher's Daughter," "Spanish Eyes," a studio take of "Fire," and a full band "The Promise"
Disc 6: Darkness Bloopers DVD, two hours of mistakes committed during the 1978 tour. Wait until you see Roy start "Streets of Fire" instead of "Fire." Watch Bruce switch the second and third verses of "Rosalita." Includes bonus mistakes from when the band played the album in full for the first time at the Count Basie Theater in Red Bank.

Notes: Here in North Carolina last night, Rosanne Cash brought her tour to Page Auditorium, in the shadow of the Duke Chapel on the university's campus — with a surprise guest up her sleeve. The first hint that a Springsteen was in the building came when Cash dedicated her performance of "Girl From the North Country" to Sam, a big Bob Dylan fan. But really, we only figured that one out retroactively. It was still a gobsmacking surprise when, mid-show, Cash introduced "Sea of Heartbreak," a song she said she was honored to sing on The List with "one of the quintessential American voices": "Usually, I'd say that John Leventhal will be playing the part of Bruce Springsteen; tonight, Bruce Springsteen will be played by Bruce Springsteen."

The Boss himself, decked out in cargo pants and apparently in town to look at colleges, emerged from stage left, to a chorus of "Bruce!" from the crowd, for their Grammy-nominated Don Gibson duet. They performed it beautifully, and the crowd responded with a standing ovation; while the audience roared, Cash thanked him for being a "gentleman" and showing up on such short notice.

The rest of her show was top-notch as well, with stand-out guitar work from husband Leventhal, more songs from The List, and backing from Mark O'Connor's trio on two songs from Black Cadillac. Cash expressed hopes that her own "Seven Year Ache" might make her daughter's own list one day. But for the dumbstruck Springsteen fans in the crowd — and there were clearly quite a few — that mid-show moment was the almost-surreal highlight. I mean, this sort of thing may happen every other Tuesday in New Jersey, but south of the Mason Dixon line?

Quick update on The Darkness Box.

I spoke to Dave Marsh on Friday, he indicated that the project is still active.

Thom Zimmy is doing a lot of work on editing the live video portion of the box. He said that Thom said it was tough going.

More to be revealed.

Thanks for the update Buddah....Although their are a number of Springsteen fans who don't hold Dave Marsh in the highest regard. But let's hope the Darkness project does see the light of day. Fuck you Gazza, Will ya?
