" We will never know why. We already know how, but we don’t care about that. And we know, beyond the slightest doubt, that it will happen again.

There can be no rational motive for mass murder, which means that asking why Stephen Paddock turned the Las Vegas Strip into a killing zone is ultimately a futile exercise. He may have had nominal or imagined reasons for his homicidal anger. But nothing can really explain the decision to spray thousands of concert-goers with automatic weapons fire, killing at least 59 and injuring hundreds more.

The attack wasn’t terrorism, authorities quickly said, as if this assessment somehow lessened the horror. Would someone please explain to me how that works? Are friends and family members of the dead supposed to feel one way if the murderer yells “God is great” in Arabic, and another way if he doesn’t? What if the killer were to say those same words in English?

Investigators and reporters will now sift through Paddock’s life for signs of chronic mental illness or sudden psychological deterioration. But what will that search tell us except the obvious? Of course Paddock was disturbed. Who in his right mind mows down innocent strangers at a country music festival?

But of the many people who are not in their right minds, which ones are violent enough to commit such a heinous act? There is no reliable way to tell. An announcement like “I’m about to explode” is hardly ever followed by actual detonation.

What we do know about Paddock, 64, is that he lived in the nearby town of Mesquite and often came to the Strip to gamble and attend country music shows. We also know, according to Clark County Sheriff Joseph Lombardo, that Paddock brought more than 10 firearms to his room on the 32nd floor of the Mandalay Bay Resort and Casino.

So the “how” of this tragedy is simple: Our nation is flooded with guns, and the constitutionally protected right to “keep and bear arms” — established in the age of single-shot blunderbusses and muskets — has been deemed to include military-style semiautomatic assault rifles and other high-powered weapons.

Sound from cellphone videos taken during the Las Vegas massacre clearly indicates that Paddock was using a fully automatic rifle — meaning that squeezing and holding the trigger unleashed a long, continuous burst of gunfire. Such machine guns were supposedly outlawed in 1986, but there are two huge loopholes: In some states, it is legal to buy and sell machine guns that were made before 1986; and Internet merchants sell kits that convert semiautomatic rifles into fully automatic killing machines.

No deer hunter or target-shooting enthusiast needs a weapon intended for war zones — a weapon designed and optimized for use by soldiers against enemy forces. But if the Newtown, Conn., massacre of 6-year-olds and 7-year-olds didn’t even lead to universal background checks for gun purchasers, let alone a ban on assault weapons, I don’t see why anyone should believe things will be different this time around.

The Supreme Court has stated explicitly that reasonable gun-control measures are permissible under the Constitution. But can you imagine this Congress and this president doing the right thing? Neither can I. We’ll need a different Congress and a different president to make progress.

But even if I could snap my fingers and change the law, there would still be an estimated 300 million guns in the United States — roughly one per person. Which means that the quotidian carnage would continue.

Assume Sunday was an average day. If the Las Vegas killings had not happened, nearly 100 people around the country would have been killed by firearms. About two-thirds of those deaths would have been suicides; nearly all the rest, homicides — about 12,000 a year. We have become emotionally and intellectually numb to this appalling toll.

A mass shooting or a terrorist rampage, on the other hand, rivets the nation. Television networks shift into continuous “breaking news” coverage. Newspapers rush to profile the shooter, then the victims. The president makes a statement expressing the nation’s grief. Gun-rights advocates pre-emptively declare that this is not the time to talk about gun control, accusing anyone who does of politicizing tragedy. Gun-control proponents ask: If not now, then when? Everyone agrees we should do something about mental health, but we end up doing nothing. A long series of funerals ends the ritual.

We go back to our routines as if there won’t be a next time. But there will. And we all know it.  "

" Consider what is, for the moment, an entirely hypothetical question: What might Secretary of Defense James Mattis do if he received an order from President Donald Trump to launch a nuclear attack on North Korea in retaliation, say, for a hydrogen-bomb test that had gone awry?

Certainly, Mattis could try to talk the president out of the attack, if he thought the action was unwise. He could request delays to prepare for contingencies or gather intelligence. He could even, perhaps, argue that the action raised legal questions, because it might cause disproportionate civilian casualties in North and South Korea and thereby violate the laws of war.

Yet, in the end, legal experts argue that Mattis would have to follow the orders of his commander in chief. That’s the way our system works. If his efforts at persuasion failed, Mattis could resign. But if he stayed on the job and refused a lawful presidential order, he could be fired.

“The president’s view, and whatever orders stem from that view, carry the day,” wrote Jack Goldsmith, a Harvard professor and a widely respected authority on national security law, in a recent post on the Lawfare blog.

But take a closer look, if you worry that Trump’s impulsive decisions could crash the ship of state against the rocks. Research reveals some fascinating instances when another erratic president, Richard Nixon, was checked by his subordinates.

Let’s start with a little-known confrontation that involves, yes, North Korea. On April 14, 1969, North Korean fighters shot down a Navy EC-121 reconnaissance plane over international waters, killing all 31 crew members. Nixon wanted to retaliate militarily, as did his national security adviser, Henry Kissinger. But Defense Secretary Melvin Laird was wary, fearing that the U.S. wasn’t ready for the consequences that might follow.


So Laird slow-rolled the process. He delayed action. He presented studies. He halted the additional surveillance flights needed to gather intelligence prior to a strike. Citing a Pentagon logistics study, he told Nixon that he doubted “we have the capability now to handle a major confrontation in Korea.”

And Laird prevailed. The retaliatory strike Nixon wanted never happened. Reading the account by Richard Hunt published by the Historical Office of the Secretary of Defense, it seems that Laird accomplished a classic case of bureaucratic obstruction.

Nixon could make mercurial, intemperate statements, much like Trump. In August 1969, terrorists hijacked a TWA flight and flew the plane to Damascus, Syria. According to Evan Thomas in “Being Nixon,” the president received the news as he was having cocktails in San Clemente, Calif.

“Bomb the airport,” Nixon ordered. This time, Kissinger was cautious. Thomas quotes him as deciding “to give the president the opportunity to have second thoughts.” Kissinger slowed movement of carriers to the eastern Mediterranean. Laird was also wary. He planned to cite “weather delays” to tarry the carriers even more.

The next morning, while being briefed on carrier movement, Nixon asked Kissinger if “anything else” happened. Kissinger said, “No,” and Nixon answered “Good.” Kissinger wrote later that he “never heard another word about bombing Damascus.”

A final example of sand in the presidential gears comes from Jeffrey H. Smith, a former CIA general counsel who during the Nixon era was a young Army lawyer. Smith recalled in a recent post on Just Security that in August 1974, a few days before Nixon’s resignation, he was shown a message from the chairman of the Joint Chiefs of Staff to subordinate commanders, advising that if they received any White House “execute orders” to use force, they should confirm them first with the chairman or the secretary of defense.

Thomas explains in his book: “Worried that the president might do something desperate, Defense Secretary James Schlesinger passed the word that all commands to the troops from the White House must pass through him.” Schlesinger later claimed that he just wanted to reinforce the chain of command. This episode has also been explored by Garrett Graff in Politico.

What could our imaginary Mattis do, if he tried similar methods of caution, but the president still wanted to launch what Mattis and his commanders viewed as an unwise attack?

Well, there’s a remedy for that in our Constitution. The 25th Amendment provides that the vice president and a majority of the Cabinet officers can inform Congress that the president is unable “to discharge the powers and duties” of his office. The vice president will take over, unless two-thirds of the House and Senate back the president.

But mind you, this is all hypothetical. As the Nixon stories show, even the most willful presidents usually end up listening to Pentagon advice.  "

" Do President Trump’s Cabinet members have to call him “Dear Leader” when graced by his august presence? Must they enter the Oval Office on bended knee? Do they weep with joy when he reaches out a delicate hand and pats their bowed heads?

One of the most appalling aspects of the Trump presidency is the sycophancy he requires of the officials who serve him. Trump demands not just loyalty but flattery, too. He insists that his courtiers treat his pronouncements, however absurd or offensive, as infallible holy writ. Members of his Cabinet have made a humiliating bargain: humor him, suck up to him, and maybe — just maybe — he will leave you alone and let you make policy.

Or maybe not. Secretary of State Rex Tillerson has been working as best he knows how to address the issue of North Korea’s nuclear program through diplomacy. Trump undercut him with a tweet, saying Tillerson was “wasting his time.”

If Trump actually believes there is a viable military solution to the North Korea problem, he’s even crazier and more dangerous than I thought. More likely, in my view, is that Trump is annoyed at Tillerson for being insufficiently servile. I doubt the president has forgotten or forgiven Tillerson’s reaction to Trump’s deeply offensive “many sides” analysis of Charlottesville. “The president speaks for himself,” Tillerson coldly said.

And Trump clearly went ballistic Wednesday at the NBC News report that Tillerson, during a meeting with defense officials, had referred to him as a “moron.” The president loosed a flurry of tweets claiming the whole thing was “fake news,” culminating in a demand Thursday for a congressional investigation of news outlets whose reporting he does not like.

This is happening in the United States.

Tillerson is no diplomatic genius, but he is no flunky, either. He occupies an office established by the Constitution and once held by Thomas Jefferson. It was painful to see him have to call a news conference — which he never does — to deny that he actually called the president a moron. Except that he didn’t deny it. He later sent out a spokeswoman to say “the secretary does not use that type of language.”

Tillerson pushed back hard against the suggestion that he had considered resigning and been talked out of it by Vice President Pence. But widespread news reports tell a different story. Tillerson, whom Trump is said to sometimes deride as “Mr. Exxon,” never would have become chief executive of one of the biggest corporations in the world if he had valued blind loyalty over principled expertise in his subordinates. His business-world methodology has not translated well to government, but he approaches his duties in a sober and responsible way.

Trump does not. Retiring Sen. Bob Corker (R-Tenn.), chairman of the Foreign Relations Committee, encouraged Tillerson to stay on because he, Defense Secretary Jim Mattis and White House Chief of Staff John F. Kelly “are those people that help separate our country from chaos.” Corker said he hoped the secretary of state would be more “supported” in his diplomatic efforts. Fat chance.

It’s hard to imagine Tillerson being willing to take much more of this, but other Cabinet members have made their peace with the Sun King’s demand for unctuous deference. Treasury Secretary Steven Mnuchin looked as if he were in physical pain as he went on the Sunday shows and defended Trump’s demand for NFL players who kneel during the national anthem to be fired.

Chief economic adviser Gary Cohn, who almost quit after Charlottesville, told reporters he stayed on for the “once-in-a-lifetime opportunity” to enact sweeping tax reform. Maybe the recently departed Tom Price stuck around so long at Health and Human Services for all the sweet travel perks.

What these officials don’t seem to fully grasp is that their policy initiatives can be undercut by the president at any time, and probably will. Look at budget director Mick Mulvaney, who has big ideas about shrinking government and the deficit. He didn’t anticipate having to wipe away Puerto Rico’s debt, which Trump offhandedly promised to do.

Someday we may look back and thank these officials for standing between our nation and the abyss. For now, I suppose they will continue telling Trump how strong he is, how wise, how special. Why, did you see him tossing those rolls of paper towels in Puerto Rico? Magnificent! The ungrateful NBA star Stephen Curry, who still is not invited to the White House, can only dream of such form!  "
